American Wealth Bullion Group LLC d/b/a American Wealth Group (“AWG”), a Nevada limited liability company · 304 S. Jones Blvd., #7711, Las Vegas, NV 89107
Welcome to the American Wealth Group website. AWG maintains this site as a service to its customers. By using this site, you agree to comply with and be bound by these terms and conditions of use. Please review them carefully. If you do not agree, do not use this site.
1. Agreement
This Terms of Use agreement (the “Agreement”) sets out the terms and conditions for access to and use of AWG’s website at theamericanwealthgroup.com (the “Site”). AWG may modify this Agreement at any time by posting the modified version on the Site. Modifications take effect when posted. The most recent version is always available at theamericanwealthgroup.com/terms-of-service. By viewing and using the Site, you accept this Agreement. Your electronic acceptance has the same effect as a signed writing (NRS Chapter 719, Nevada’s Uniform Electronic Transactions Act).
2. Purchases Are Governed by the Transaction Agreement
This Agreement covers use of the Site only. Every purchase, sale, IRA transaction or buyback is governed by the AWG Customer Transaction Agreement and its disclosures, which you sign before your order is final. The Transaction Agreement covers pricing, cancellation rights, payment, delivery, returns, dispute resolution and arbitration. If this Agreement and the Transaction Agreement conflict about a transaction, the Transaction Agreement controls.
Nothing in this Agreement limits rights you have under Nevada law. These include your right to a refund or replacement for products that are defective, not as represented, or not received (NRS 599B.190), and your rights as a person 60 or older (NRS 599B.270 to 599B.300).
Shipment problems. Please report any shortage, discrepancy or shipping damage within ten (10) calendar days after delivery, and keep all packaging, so AWG can file the carrier insurance claim (Transaction Agreement Section 16). This 10-day reporting window does not shorten your separate 30-day right under NRS 599B.190 to a refund or replacement for products that are defective, not as represented, or not received.
3. Privacy
Your use of the Site is also governed by our Privacy Policy at theamericanwealthgroup.com/privacy-policy, which is incorporated into this Agreement.
4. No Investment, Tax or Legal Advice
AWG is a precious metals dealer. It is not an investment adviser, broker-dealer, tax adviser, IRA custodian or depository.
Content on the Site is general education only. This includes guides, articles, calculators, quizzes, market commentary and historical prices. It is not a recommendation to buy or sell, and it is not investment, tax or legal advice.
Precious metals and rare coins involve substantial risk, including the risk of loss. Prices are volatile, and past performance does not guarantee future results. Your decisions are yours alone. Please consult your own financial, tax and legal professionals.
5. Bullion and Rare Coins
AWG primarily sells bullion, which is priced on its metal content. On a customer’s own request, AWG may also sell numismatic coins (rare, graded or collectible coins) for cash (non-IRA) purchases. Before you buy a numismatic coin, please understand:
- Numismatic coins are priced on rarity, grade and collector demand, not only metal content. They carry higher premiums than bullion.
- Their resale value can be much lower than the price paid. The spread between AWG’s sell price and buyback price is wider than for bullion. They can be harder to sell quickly.
- A coin’s grade is assigned by an independent grading service, such as PCGS or NGC. AWG does not guarantee any grade beyond that service’s certification.
- Numismatic coins generally cannot be held in an IRA (26 U.S.C. 408(m)). AWG will not sell them into an IRA.
- Before a numismatic order is final, AWG discloses in writing how the price was determined and the premium over metal value (NRS 599B.185). You will sign a separate numismatic disclosure and acknowledgment.
6. Pricing and Availability
Prices, spot quotes and product availability shown on the Site are indications only. They may be delayed and can change without notice. A price is binding only when it is confirmed in a recorded call and an invoice under the Transaction Agreement.
7. Ownership
All content on the Site is and remains the property of AWG or its content suppliers. It is protected by copyright, trademark and other intellectual property laws. You may not copy, redistribute, use or publish any content or part of the Site without AWG’s express written permission. You acquire no ownership rights in any content by using the Site.
8. Intended Audience
The Site is intended for adults 18 and older who live in the United States. It is not intended for anyone under 18. AWG does not knowingly collect information from children under 13 (15 U.S.C. 6501 et seq.; NRS Chapter 603A).
9. Trademarks
“American Wealth Group,” “AWG” and the AWG logo are trademarks of AWG. Other product and company names on the Site may be trademarks of their owners, including those of custodians, depositories, mints and grading services. Their use does not imply endorsement.
10. Site Use
You are granted a limited, revocable, nonexclusive license to use the Site only for your own personal use. You may not republish, distribute, assign, sublicense or sell the Site or its content, or create derivative works from it. You agree not to:
- copy materials on the Site;
- reverse engineer or break into the Site;
- scrape the Site with automated tools; or
- use the Site’s materials, products or services in violation of any law.
AWG may suspend or end your use of the Site at any time.
11. Compliance with Laws
You agree to comply with all laws that apply to your use of the Site. You agree that the information you provide is truthful, accurate and your own. You agree that any phone number you provide belongs to you or is one you are authorized to use.
12. Communications Consent
When you submit a form on the Site, you agree that AWG may contact you about your request at the email address and phone number you provide. If you checked the consent box, AWG may also send you marketing messages. These may include calls and texts made with automated technology or a prerecorded voice, even if your number is on a Do Not Call registry (47 U.S.C. 227; 47 CFR 64.1200; 16 CFR 310.4).
Consent is not a condition of purchase. Calls are recorded, and you are told so at the start of each call (NRS 200.620). Automated calls follow Nevada’s rules on calling hours and caller identification (NRS 597.814).
13. SMS Terms
AWG’s text messaging program sends account updates, appointment reminders and marketing messages to people who opt in.
- Message frequency varies. Message and data rates may apply.
- Reply STOP to cancel at any time. You will receive one confirmation message, and then no further messages.
- Reply HELP for help, or contact Corporate@awg-us.com or 1-855-AWG-METL (1-855-294-6385).
- To receive texts again, sign up the same way you did the first time.
- Carriers are not liable for delayed or undelivered messages.
- Mobile information is never shared with third parties for their marketing.
14. Reviews and Testimonials
Customer reviews on or linked from the Site reflect individual experiences and may not be typical. AWG does not write, buy or alter reviews, and it does not suppress negative reviews. Any material connection, such as compensation, will be disclosed. This follows the FTC’s rule on consumer reviews and testimonials (16 CFR Part 465) and Nevada’s deceptive trade practices law (NRS 598.0915).
15. Indemnification
You agree to indemnify, defend and hold harmless AWG and its officers, directors, members, consultants, employees and affiliates from any liability, loss, claim and expense, including reasonable attorney’s fees, arising from your violation of this Agreement or your misuse of the Site.
16. Disclaimer
THE INFORMATION ON THIS SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” YOU AGREE THAT YOUR USE OF THE SITE IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT ALLOWED BY LAW, AWG DISCLAIMS ALL WARRANTIES OF ANY KIND, INCLUDING EXPRESS, STATUTORY AND IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. IF YOUR JURISDICTION DOES NOT ALLOW LIMITS ON WARRANTIES, THIS LIMIT MAY NOT APPLY TO YOU. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SITE IS TO STOP USING IT.
THIS SECTION APPLIES TO THE SITE ONLY. IT DOES NOT LIMIT ANY WARRANTY OR RIGHT IN THE TRANSACTION AGREEMENT OR UNDER NEVADA LAW, INCLUDING NRS 599B.190.
17. Limitation of Liability
TO THE FULLEST EXTENT ALLOWED BY LAW, AWG WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL (INCLUDING LOSS OF BUSINESS, LOST PROFITS OR LITIGATION), SPECIAL, EXEMPLARY, PUNITIVE OR OTHER DAMAGES, UNDER ANY LEGAL THEORY, ARISING FROM OR RELATING TO THE SITE, YOUR USE OF THE SITE, OR ITS CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You may have added rights under consumer protection laws that do not allow excluding implied warranties or limiting certain damages, including NRS Chapter 598 and NRS 41.1395. If those laws apply to you, the parts of this Agreement that conflict with them do not apply to you.
18. Use of Information
AWG may use information about your use of the Site, and information you provide, only in ways consistent with our Privacy Policy.
19. Copyright Notices
If you believe your work has been copied in a way that is copyright infringement, or your intellectual property rights have otherwise been violated, send a notice to AWG’s designated agent (17 U.S.C. 512(c)). Email it to Corporate@awg-us.com with the subject “Copyright Notice,” or mail it to 304 S. Jones Blvd., #7711, Las Vegas, NV 89107. The notice must include:
- An electronic or physical signature of the person authorized to act for the owner of the copyright or other interest.
- A description of the copyrighted work you claim has been infringed.
- A description of where on the Site the material you claim is infringing is located.
- Your address, telephone number and email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act for the owner.
20. Opt-In and Opt-Out
You may withdraw consent to calls, texts or emails at any time by any reasonable means:
- reply STOP to a text;
- click “unsubscribe” in an email;
- tell your representative; or
- contact Corporate@awg-us.com or 1-855-AWG-METL (1-855-294-6385).
AWG honors requests within 10 business days (47 CFR 64.1200(a)(10)).
21. Accessibility
AWG wants the Site to be usable by everyone and works toward the WCAG 2.1 Level AA guidelines. If you have trouble using any part of the Site, call 1-855-AWG-METL (1-855-294-6385) or email Corporate@awg-us.com. We will provide the information another way.
22. Third-Party Links
The Site may link to third-party websites, such as custodians, depositories, mints and grading services. AWG does not control them and is not responsible for their content or practices.
23. Disputes and Time to Bring a Claim
(a) Informal resolution first. Before filing any claim, contact AWG at Corporate@awg-us.com and give us 30 days to resolve it informally under our Customer Resolution and Dispute Procedure. The Procedure is posted at theamericanwealthgroup.com/customer-service.
(b) Transactions. Disputes about a transaction are resolved as the Transaction Agreement provides, including its arbitration terms. Nevada’s Uniform Arbitration Act (NRS 38.206 to 38.248) and the Federal Arbitration Act (9 U.S.C. 1 et seq.) apply to those terms.
(c) Site disputes. For a dispute about the Site that is not resolved informally, you and AWG agree to the exclusive jurisdiction of the state and federal courts in Clark County, Nevada. Either party may bring an individual claim in small claims court (Justice Court, Las Vegas Township).
(d) Time to bring a claim. Any claim arising from or relating to the Site or this Agreement must be brought within two (2) years after the claim accrues. This matches Section 52 of the Transaction Agreement (NRS 104.2725). Claims arising under a statute or in fraud may be brought within the period Nevada law provides, including claims under NRS Chapters 598 and 599B and NRS 41.1395. The two-year period is paused while a written complaint is open under the Customer Resolution and Dispute Procedure.
(e) Government agencies. Nothing in this Agreement prevents you from contacting a regulator at any time. You may contact the Nevada Attorney General’s Bureau of Consumer Protection (ag.nv.gov) or Nevada Consumer Affairs (consumeraffairs.nv.gov). You may also contact your own state’s attorney general.
24. Applicable Law
The laws of the State of Nevada, without regard to conflict-of-laws principles, govern this Agreement and any dispute between you and AWG or its affiliates.
25. Severability
If a court of competent jurisdiction finds any provision of this Agreement unenforceable or invalid, that provision will be limited or removed only as much as necessary. The rest of this Agreement stays in full force.
26. Waiver
AWG’s failure to exercise or enforce any right or provision of this Agreement is not a waiver of that right or provision. Any waiver by AWG must be in writing and signed by an authorized representative of AWG.
27. Termination
AWG may terminate this Agreement or your access to the Site at any time, with or without notice, for any reason. Sections 4, 5, 7, 15 to 17 and 23 to 26 survive termination.
28. Relationship of the Parties
Nothing in this Agreement or your use of the Site makes either party a partner, joint venturer, employee or agent of the other. Neither party may hold itself out as one. Neither party has authority to create any obligation in the other’s name. Each party remains independent and responsible for its own actions.
29. Entire Agreement
This Agreement, the Privacy Policy and the AML Policy are the entire agreement between you and AWG about your use of the Site. They replace all prior communications and proposals about the Site, whether electronic, oral or written. Your purchases are also subject to the Transaction Agreement and any other posted policies.
AWG may revise this Agreement by posting an update, so please check it periodically. Continuing to use the Site after a change means you accept it.
30. Licenses and Contact Information
AWG is a registered telephone seller in the State of Nevada under NRS Chapter 599B. AWG holds the state and local business licenses required to buy and sell precious metals in Clark County and the City of Las Vegas.
